1. GENERAL TERMS

This public offer constitutes a legally binding agreement between Polina Venglovskaia (the “Photographer”) and the client upon acceptance of services and payment of deposit.

2. SERVICES OFFERED

Enchanted Portrait — £120

• 1.5 hours on-location photography session in London
• Pre-shoot consultation and styling guide
• Access to costume collection
• 20 edited photographs
• 5 retouched photographs
• 1 short reel format video
• Online gallery delivery within 2-3 weeks
• Teaser images within 24 hours

Extended Enchanted — £200

• 2.5 hours on-location photography session
• Multiple costume changes included
• 30 edited photographs
• 8 retouched photographs
• 2 short reel format videos
• All other inclusions as above

Group Sessions — £90 per person (minimum 2 people)

• Extended session time
• Individual portraits for each person
• Group photographs included
• Same inclusions as Enchanted Portrait per person

2.1 Additional Services:

• Extra 30-minute blocks: £30 each
• Travel outside London: quoted separately
• Additional editing requests: priced on consultation

3. BOOKING AND PAYMENT

• 30% non-refundable deposit required to secure booking
• Remaining balance due on shoot day
• Payment accepted via PayPal
• Prices include travel within London (up to £10)

4. CANCELLATION POLICY

4.1 Client Cancellations:

• Cancellations with less than 24 hours notice forfeit the 30% deposit
• Rescheduling requires 24 hours notice minimum
• Deposit retained for rescheduling but applied to new date

4.2 Weather Cancellations:

• Outdoor sessions affected by severe weather will be rescheduled at no charge
• Light rain or overcast conditions do not constitute cancellation

4.3 Photographer Cancellations:

• In case of illness or emergency, full deposit refund or transfer to new date offered

5. DELIVERY AND USAGE RIGHTS

5.1 Image Delivery:

• Final gallery delivered within 2-3 weeks via private online gallery
• Teaser images provided within 24 hours
• Only edited images provided — raw files never shared
• Gallery link active for 90 days after delivery

5.2 Usage Rights:

• Images licensed for personal use and social media sharing
• Photographer credit required when sharing: @moth.and.moss
• Commercial use requires separate licensing agreement
• Print rights included for personal use
• Client may not sell, distribute, or use images for commercial purposes without written permission
• Images may not be edited, enhanced, filtered, altered, or modified in any way without the photographer’s written permission. This includes but is not limited to: colour correction, digital filters, text overlays, or any other modifications. Cropping is allowed. 

5.3 Photographer Rights:

• Photographer retains copyright to all images
• Photographer may use images for portfolio, marketing, and social media
• Client may request that selected images remain private and not be used for promotional purposes. This service incurs a 40% markup on the base package price.

6. SESSION TERMS

6.1 Session Guidelines:

• Timing begins upon arrival at agreed location
• Guests and friends welcome during shoots
• Client responsible for any location fees or permits if required
• Costume pieces provided are for photography use only

6.2 Client Responsibilities:

• Arrive on time and prepared as per preparation guide
• Inform photographer of any health conditions affecting participation
• Respect equipment and costume pieces
• Follow safety guidelines during shoot

7. LIABILITY AND LIMITATIONS

7.1 Photographer Liability:

• Photographer maintains public liability insurance
• Liability limited to amount paid for services
• Not responsible for personal belongings or injuries during shoot
• Weather-dependent outdoor sessions subject to natural conditions

7.2 Artistic Satisfaction:

• Client acknowledges having reviewed the photographer’s portfolio and style prior to booking
• No refunds will be provided for subjective dissatisfaction with the photographer’s artistic interpretation, style, or creative choices, provided the contracted services have been delivered as specified

7.3 Equipment and Technical Issues:

• Multiple backup systems in place
• In rare case of complete technical failure, full refund or reshoot offered
• Photographer not liable for issues beyond reasonable control

8. FORCE MAJEURE

Services may be cancelled or postponed due to circumstances beyond control including but not limited to: severe weather, natural disasters, government restrictions, or health emergencies. Full refund or rescheduling offered in such cases.

9. PRIVACY AND DATA PROTECTION

• Personal information collected only for service delivery
• Data stored securely and not shared with third parties
• Client images stored securely with backup systems
• Clients may request removal from marketing materials at any time. This service incurs a 40% markup on the base package price.

10. DISPUTE RESOLUTION

• Good faith communication attempted first
• Disputes governed by English law
• Mediation preferred before legal action
• Jurisdiction: Courts of England and Wales

11. AMENDMENTS

• Terms may be updated at any time. Changes apply to new bookings immediately and to existing bookings with 7 days notice.
• Clients with existing bookings will be notified of any changes affecting their services.
• Current version always available on website
• Bookings subject to terms active at time of booking

12. ACCEPTANCE

By booking services and paying deposit, client agrees to all terms in this public offer.
